A production’s value rests on the strength of its chain of title: a single missing link can block a broadcast or a sale. Here are the five links to lock down, from development to distribution.
1. Authors
Script, adaptation, dialogue, direction: every author’s contribution requires an agreement compliant with the French Intellectual Property Code — rights itemized, remuneration per mode of exploitation.
2. Music
Original or pre-existing, synchronization requires clearance from publishers and record producers. Missing clearances always cost more once the edit is locked.
3. Performers
Actors, musicians, voice artists: their neighbouring rights must be assigned in writing, covering the intended modes of exploitation. Watch for new uses — platforms, clips, social media — not covered by older agreements.
4. Formats and options
Adapting a book, a foreign format or a pre-existing work: the option agreement and then the adaptation assignment must be secured before development begins — duration, exercise price, reversion of rights.
5. Distribution
Distribution mandates, pre-sales, territories, windows: check the consistency between the rights acquired upstream and the commitments made downstream. That is where the chain’s gaps reveal themselves — at the worst moment.
